HB 1416 Ratio Waiver List Products

The 2025-2026 HB 1416 Ratio Waiver List application submission window will open on October 14, 2024, and close on December 6, 2024.

Texas Education Code (TEC), §28.0211 requires that students not receiving approaches or higher on STAAR grades 3 through 8 or End of Course assessments receive accelerated instruction. House Bill 1416, 88(R) provides that the Texas Education Agency (TEA) shall approve automated, computerized, or other augmented method products for providing accelerated instruction. The HB 1416 Ratio Waiver List consists of approved products that may be used to waive the 4 to 1 student to tutor ratio required in statute.  

House Bill 1416, 88(R) requires TEA to approve automated, computerized, or other augmented method products for providing accelerated instruction. Approved products may be used to waive the 4 to 1 student to tutor ratio required by statute if evidence indicates that the product is more effective than individual or group instruction. These products also remove the need for a live in-person or virtual tutor. LEAs may still use any curricular tool they choose to support accelerated instruction, but only products approved through the HB 1416 Ratio Waiver List qualify for the waiver of the 4 to 1 student to teacher ratio.  

Interested vendors may request the 2025-2026 HB 1416 Ratio Waiver List application by emailing  accelerated.instruction@tea.texas.gov.  

Vendor Requirements

All approved vendors must comply with the HB 1416 Ratio Waiver List Fall 2024 vendor requirements including technical support, data sharing, and compliance with state suitability laws and the approved SBOE suitability rubric. Non-compliance may result in removal from the list.

Evaluation Criteria

Products eligible for approval on this list do not require live in-person or online educators to deliver primary mode of instruction.  

Qualified products will be evaluated based on evidence provided which include, but are not limited to, the following components: 

  • TEKS alignment per applicable subject/grade level for all learners 
  • Formative and summative assessments and progress monitoring tools/reports 
  • Recommended research-based usage metrics for the product 
  • Rigorous research studies evaluating product efficacy 
  • Evidence that indicates the product is more effective than individual or group instruction as required by statute 
  • Evidence must reflect that high fidelity usage of the product yields higher student outcomes than students who did not use the product 

Process to Apply 

TEA will recommend products based on their ability to provide evidence of the previously stated components, verification of these components, and review of the outcomes study. Final inclusion on the HB 1416 Ratio Waiver List is at the discretion of the Commissioner of Education.

Vendors who are seeking inclusion to the TEA HB 1416 Ratio Waiver List for providing accelerated instruction for the 2025-2026 school year must complete the HB 1416 Ratio Waiver List Application in its entirety. Applications will be available starting on Monday, October 14 and must be submitted by Friday, December 6. Vendors will be notified of approval status in spring 2025.

To benefit from the waived ratio requirement, applicable students must meet minimum product usage requirements for the approved product. A school district not meeting usage requirements with a product will be required to revert to the 4:1 ratio for supplemental instruction (19 TAC §104.1001).

LEAs may still use any curricular tool they choose to support accelerated instruction, but only products approved through this list qualify for the waiver of the 4 to 1 student to tutor ratio.  

Note: Teachers are the single most important in-school factor impacting student outcomes (Hattie, 2011). The tools approved on this list – when implemented effectively with quality educator training and sufficient time in a master schedule – can reduce educator workload while addressing individual learning gaps in full group or high impact tutoring settings. These tools are not a substitute for excellent teaching.
