Certification of Provision of Instructional Materials

(Formerly Known as the TEKS Certification Process)

Local educational agencies (LEAs) are required to certify annually to the State Board of Education (SBOE) and the commissioner that students have access to instructional materials covering all Texas Essential Knowledge and Skills (TEKS) for all required subjects, except physical education, per Texas Education Code (TEC) 31.1011.  

TEA utilizes the following tools for the Certification of Provision of Instructional Materials process:  

  • The Certification 2025–26 Form is a printable, hard copy of the survey, that is to be completed offline and presented to an LEA’s board of trustees or governing body for ratification and signatures. 
  • The Certification 2025–26 Survey is a web-based application where LEAs will submit their responses, collected on the TEKS Certification 2025–26 Form, and where LEAs will upload the signature page of the Form. 

The 2025–26 Certification Survey includes a section that allows an LEA to certify that they meet the requirement to protect against access to obscene or harmful content in compliance with: 

  • (i) Children's Internet Protection Act (Pub. L. No. 106-554);  
  • (ii) Section 28.0022;  
  • (iii) Section 43.22, Penal Code; and  
  • (iv) any other law or regulation that protects students from obscene or harmful content. 

Required Actions for LEAs

The certification process for the school year 2025–26 requires:  

  • the completion of the Certification 2025–26 Form (available now); 
  • ratification of the Certification 2025–26 Form by an LEA’s board of trustees or governing body in an open, public-noticed meeting; and  
  • submission of the Certification 2025–26 Survey with the ratified Certification 2025–26 Form attached (survey opens for submissions on Monday, March 24, 2025).

The Certification of Provision of Instructional Materials 2025–26 Survey submissions are typically processed within five business days. After a submission is processed, access to instructional materials funds in EMAT will be granted. 

The state online instructional materials ordering system, EMAT, will close for annual maintenance on March 28, 2025, and is scheduled to reopen on May 15, 2025. Completion of the Certification Process is required to regain access to instructional materials funds when EMAT reopens.

Steps to Complete the Certification Process for 2025–26

TEA recommends that LEAs complete the following steps no later than May 1, 2025: 

  1. Review the Certification 2025–26 Form.  The form can be printed or viewed digitally.  
  2. Gather information.  The form may require consultation with content area leads or other LEA staff.  
  3. Complete the Certification 2025–26 Form. The form can be completed by hand or digitally.  
  4. Obtain the required signatures. Receive signatures by ratifying the Certification 2025–26 Form during an open board meeting by the board of trustees or other governing body.
  5. Submit Certification 2025–26 Survey. Complete the online Certification 2025–26 Survey by answering the questions. There is a place inside the survey to upload the signature page from the Certification 2025–26 Form to illustrate ratification. The survey will be open for submissions beginning Monday, March 24, 2025.
