Certification of Provision of Instructional Materials

Local school systems are required to certify annually to the State Board of Education (SBOE) and the commissioner that students have access to instructional materials covering all Texas Essential Knowledge and Skills (TEKS) for all required subjects, except physical education, per Texas Education Code (TEC) 31.1011.  

TEA utilizes the following tools for the Certification of Provision of Instructional Materials process:  

  • The certification form is a fillable copy that is to be completed offline and presented to a local school system's board of trustees or governing body for ratification and signatures.  
  • The certification survey is a web-based application where local school systems will submit their responses collected on the certification form, and where the signature page of the form will be uploaded. 

The certification survey includes a section that allows a local school system to certify that they meet the requirement to protect against access to obscene or harmful content in compliance with:  

  • (i) Children's Internet Protection Act (Pub. L. No. 106-554);  
  • (ii) Section 28.0022;  
  • (iii) Section 43.22, Penal Code; and  
  • (iv) any other law or regulation that protects students from obscene or harmful content.  

The Certification of Provision of Instructional Materials form and survey for school year 2026–27 will be available in February 2026. 

Required Actions for Local School Systems

The certification process requires:  

  • completion of the certification form;  
  • ratification of the certification form by a local school system's board of trustees or governing body in an open, public-noticed meeting; and  
  • submission of the certification survey with the ratified Certification Form attached.

The Certification of Provision of Instructional Materials survey submissions are typically processed within five business days

EMAT closes for yearly maintenance between March and April. To regain access to instructional materials funds for the 2026–27 school year after EMAT reopens, local school systems must complete Certification of Provision of Instructional Materials survey, and their submission must be processed.

Steps to Complete the Certification Process 

Once the form and survey are released, TEA recommends that local school systems complete the following steps no later than May 1, 2026:  

  1. Review the certification form.  The form can be printed or viewed digitally.  
  2. Gather information.  The form may require consultation with content area leads or other district staff.  
  3. Complete the certification form. The form can be completed by hand or digitally.  
  4. Obtain the required signatures. Receive signatures by ratifying the certification form during an open board meeting by the board of trustees or other governing body.
  5. Submit certification survey. Complete the online certification survey by answering the questions online. There is a place inside the survey to upload the signature page from the certification form to illustrate ratification; the signature page must be uploaded for the certification survey to be considered complete.
