Information About Special Education Complaints

Information Regarding Your Survey

If you found this page without taking our survey, please take the time to complete the Parent Complaint Navigator Survey.

The information contained on this page is not legal advice, nor can TEA provide legal advice. We are providing resources to inform you of the dispute resolution services available to you. Parents and guardians have the right to consider which service(s) will best support their child.

Where to start

If you believe your child's special education services are not being provided correctly, one place to start is your school district's local grievance process.  This process allows the district to look into and address concerns locally.  Most districts share their grievance steps on their website and in their handbook.

To raise the concern locally, follow your school district or charter's local grievance process.  Most districts share their grievance steps on their website and in student handbooks.

  • Timelines are generally 30 days to file a formal grievance, or up to 90 days if you first tried to resolve the issue informally.
  • Districts of Innovation (DOIs) and open-enrollment charter school timelines are generally 10 to 15 days of when you first become aware of the issue.

TEA's Special Education State Complaint process is another option available to you.  The webpage explains how to file a complaint, what forms are required, and what to expect.
