All proposed new rules, proposed amendments to existing rules, and proposed repeals being considered by the commissioner of education are available here. The rule text on this page reflects what was filed as proposed with the Texas Register. Rule actions will remain on this page until approved for adoption by the commissioner and filed as adopted with the Texas Register.

Proposed Amendment to 19 TAC Chapter 53, Regional Education Service Centers, Subchapter AA, Commissioner's Rules, §53.1001, Board of Directors 
Summary: The proposed amendment would specify that a board of trustees member for a regional education service center may not be engaged professionally in Kindergarten-Grade 12 education.

Proposed Repeal of 19 TAC Chapter 89, Adaptations for Special Populations, Subchapter CC, Commissioner's Rules Concerning Adult and Community Education, §89.1311, Memorandum of Understanding to Provide Educational Services to Released Offenders 
Summary: The proposed repeal is necessary because the statutory authority for adult basic education was transferred from the Texas Education Agency to the Texas Workforce Commission effective September 1, 2013.

Proposed Amendment to 19 TAC Chapter 100, Charters, Subchapter AA, Commissioner's Rules Concerning Open-Enrollment Charter Schools, Division 1, General Provisions, §100.1010, Performance Frameworks 
Summary: The proposed amendment would modify the existing rule to include the 2018 Charter School Performance Framework Manual as Figure: 19 TAC §100.1010(c). The new manual would be updated to comply with statutory requirements, track agency policy including academic accountability and the Financial Integrity Rating System of Texas (FIRST), and more fully utilize available school data.

Proposed Amendment to 19 TAC Chapter 101, Assessment, Subchapter CC, Commissioner's Rules Concerning Implementation of the Academic Content Areas Testing Program, Division 4, Performance Standards, §101.3041, Performance Standards 
Summary: The proposed amendment would delete language regarding Texas Assessment of Knowledge and Skills (TAKS) performance standards since Senate Bill (SB) 463 and SB 1005, 85th Texas Legislature, Regular Session, 2017, no longer require this assessment to be administered.

PROPOSED RULES WITH CLOSED PUBLIC COMMENT PERIODS BUT NOT YET FILED AS ADOPTED


 

Proposed New 19 TAC Chapter 66, State Adoption and Distribution of Instructional Materials, Subchapter DD, Instructional Materials Portal

Summary: The new rules would implement House Bill 3526 and Senate Bill 810, 85th Texas Legislature, Regular Session, 2017, by specifying procedures by which publishers submit instructional materials for inclusion in the instructional materials web portal.

Public Comment Period: February 22, 2019 - March 25, 2019
Public Hearing Notice: A public hearing to solicit testimony and input on the proposal will be held at 8:30 a.m. on March 21, 2019, in Room 1-100, William B. Travis Building, 1701 North Congress Avenue, Austin, Texas 78701. Anyone wishing to testify at the hearing must sign in between 8:15 a.m. and 9:00 a.m. on the day of the hearing. The hearing will conclude once all who have signed in have been given the opportunity to comment.

 


 

Proposed Amendment to 19 TAC Chapter 76, Extracurricular Activities, Subchapter AA, Commissioner's Rules, §76.1001, Extracurricular Activities

Summary: The proposed amendment would allow a student who has not passed all his or her classes but who is enrolled in a state-approved music course that participates in University Interscholastic League (UIL) Concert and Sightreading Evaluation to perform with the ensemble during the UIL evaluation performance.

Proposed Amendment to 19 TAC Chapter 101, Assessment, Subchapter CC, Commissioner's Rules Concerning Implementation of the Academic Content Areas Testing Program, Division 3, Security of Assessments, Required Test Administration Procedures and Training Activities, §101.3031, Required Test Administration Procedures and Training Activities to Ensure Validity, Reliability, and Security of Assessments

Summary: The proposed amendment would eliminate the 2018 Test Security Supplement as a figure and instead include specific language from the supplement regarding test security and confidentiality.
