The purpose of this letter is to provide school districts and open-enrollment charter schools (local education agencies or LEAs) with notice regarding 19 TAC §89.1094, relating to off-campus program placements for students who receive special education services. This rule went into effect on November 10, 2019. 

LEAs who have students receiving special education and related services in an off-campus program, as defined in 19 TAC  §89.1094, must electronically submit to the Texas Education Agency (TEA) notice of, and information regarding, the off-campus program placement of special education students in accordance with submission procedures specified by the TEA.  LEAs are expected to begin entering submissions for students placed during the 2019-2020 school year beginning February 12, 2020. LEAs will submit through the Nonpublic/High Cost Fund, application system within the TEAL portal. The application portal has been expanded to allow LEAs to provide notification and apply for approval of off-campus student placements. 

To support LEAs in understanding this rule, TEA has created a Frequently Asked Questions  document that was created to address questions the agency and regional education service centers  have already received regarding the rule.
