This page provides important information to publishers regarding the review, adoption, and distribution of state-adopted instructional materials.

House Bill 1605
The Texas Education Agency hosted an information session for textbook publishers to review House Bill (HB) 1605, 88th Texas Legislature, Regular Session, 2023. The bill addresses instructional materials and technology review and approval as well as the extension of additional state aid to school districts for the provision of certain instructional materials. This information session provided an opportunity for interested publishers to hear an overview of HB 1605 and to begin discussing impacts of the legislation.

Publisher Accessibility Overview
The SBOE uses a proclamation to call for new instructional materials. Proclamations are named by the year in which the new materials are intended to be made available in the classroom. The adoption cycle for foundation and enrichment subjects shows when the SBOE is tentatively scheduled to call for instructional materials.
The SBOE issued Proclamation 2024 at its April 2022 meeting (click item 10). Adopting materials under Proclamation 2024 is scheduled to occur in November 2022. The adopted materials will go into classrooms in the 2024–25 school year.

The State Board of Education (SBOE) does not plan to issue Proclamation 2023. Instructional materials for science, grades K–12, and certain CTE courses are now scheduled to be included in Proclamation 2024. You may see the SBOE’s discussion of this topic in the broadcast of the SBOE’s meeting. (Click item 5.)

The SBOE issued Proclamation 2021 at its June 2019 meeting. Instructional materials were adopted in November 2020. The adopted materials are scheduled to go into classrooms in the 2021–22 school year.

Review and Adoption Process
The review and adoption process determines the instructional materials eligible for adoption by the State Board of Education (SBOE). The process starts when the SBOE calls for new instructional materials and is complete with the selection and implementation of new materials by school districts.
Texas Essential Knowledge and Skills (TEKS)
The TEKS are the content standards that must be covered in adopted instructional materials. Publishers create correlations to provide evidence of the alignment of products submitted for adoption to the required TEKS. The state review panels are provided with the publisher's correlations in an evaluation instrument to record their findings of TEKS coverage and factual and editorial errors.
Content Updates and Substitutions
Publishers must submit a formal request to update content in or substitute a new edition of adopted instructional materials (19 Texas Administrative Code §§66.75 and 66.76). TEA posts all update requests for a minimum of seven days and posts all substitution requests for a minimum of sixty days. All requests that involve content used to determine TEKS coverage must be approved by the SBOE prior to its introduction into the material. All requests that do not involve content used to determine TEKS coverage must be approved by TEA. Without prior approval from TEA, publishers may, at any time, make changes that do not affect the content or change the technical requirements, such as technical enhancements or improvements. Publishers who fail to obtain the required approval prior to making changes to adopted materials violate the terms of the instructional materials contract and will be reported to the SBOE.

School districts and charter schools use the ordering information page to view Technology and Instructional Materials Allotment allocations, state-adopted materials list, and publisher/depository contact information.
Accessible Instructional Materials
Accessible instructional materials are ordered for students with disabilities. There are specific guidelines that publishers of print materials must follow for the creation of those materials. Electronic instructional materials must also be fully accessible for students with disabilities. Beginning with Proclamation 2017, publishers must provide an accessibility report prior to adoption by the SBOE verifying that all electronic instructional materials comply with Web Content Accessibility (WCAG) 2.0 AA standards and technical standards required by the Federal Rehabilitation Act, Section 508.

Publishers who have EMAT user names and passwords can use EMAT to submit bid information, including Statements of Intent to Bid, Complete Descriptions, and Official Bids by the specified deadlines listed in the proclamation. Publishers who do not have EMAT user names and passwords can click here to submit bid information.
Publishers can also view and process orders for adopted materials in EMAT. District and charter EMAT/EVI contacts, district order lists, and payment reports are available in the EMAT system.
Order Summary Report
The order summary report is updated nightly and lists the adopted instructional materials that have been requisitioned in EMAT for the current school year, including the publisher, title, and quantity ordered.
EMAT Vendor Payment Report
The EMAT vendor payment report allows vendors and publishers to view all of the payments received from TEA. The report includes the amount paid, the payment date, and the warrant number.
Vendor Adjustment History Report
The vendor adjustment history report shows any adjustments that have been made to a vendor’s or publisher’s account. This report can include credits processed for returned items from school districts and charter schools.
