Tuition for Students Holding Certain Student Visas

School districts and open-enrollment charter schools must charge tuition to certain foreign students under the Texas Education Code, Section 25.0031, which was enacted by the 83rd Legislature in 2013. The tuition a district or charter school charges must not exceed the tuition amount established by the commissioner of education. The files below show the commissioner-established tuition amount for each district and charter school.

The Texas Education Agency's State Funding Division is responsible for administering the Foundation School Program (FSP) and wealth equalization provisions of the Texas Education Code. The FSP determines the amount of state and local funding due to school districts under Texas school finance law and provides the state share of this funding to districts. The State Funding Division also produces reports and other data related to school finance. The division is a part of the Department of School Finance.

Chapter 41, Education Code, was repealed. House Bill 3 amended the Education Code to transfer certain sections from Chapter 41 to Chapter 49, and revised formulas used to determine excess local revenue under the FSP by adding Subchapter F, Chapter 48, Education Code, Section 48.257, Local Revenue in Excess of Entitlement. This section of the Texas Education Code (TEC) makes provisions for certain school districts to share their local tax revenue with other school districts. These provisions are sometimes referred to as “share the wealth” or “Robin Hood” plan because recaptured funds are redistributed by the school finance system to assist with the financing of public education for all school districts.
