Post Award Compliance

Local Educational Agencies (LEAs) and Education Service Centers (ESCs), including school districts and open-enrollment charter schools, must follow applicable statues, regulations and non-regulatory guidance when utilizing federal and state grant funding. The Post-Award Compliance Unit reviews grant applications to identify compliance issues related to programmatic and budgetary details post-award.  If issues of non-compliance are identified, the Post-Award Compliance Unit assists Local Education Agencies (LEAs) and Education Service Centers (ESCs) in resolving the issue via an amendment.

IDEA-B LEA MOE Eligibility Standard and Resources

Eligibility Standard: Per 34 CFR 300.203(a, b), to be eligible to receive an IDEA-B grant, each LEA must budget at least the same amount, either in total or per capita, as the amount it expended for services to children with disabilities in the most recent prior year for which information is available and when they were in Maintenance of Effort compliance.

Title I Part A, Homeless Reservation

ESEA section 1113(c)(3)(A) requires LEAs to reserve sufficient Title I, Part A funds to provide services to homeless students who attend non-Title I schools that are comparable to those provided to students in Title I schools.

Post Award Compliance ESSA Consolidated Federal Grant Application Review:  Integration of Title I, Part A Homeless Reservation Worksheet (or equivalent).  Information indicated on the Homeless Reservation Worksheet will be compared against applicable programmatic and budgetary details in the ESSA Consolidated Federal Grant application.

Title I, Part A Homeless Reservation Validation:  Compare data on the PS3101, applicable budget schedules, Title I, Part A Homeless Reservation Worksheet (or equivalent), and LEA financial records to ensure they align.  

Title II, Part A and Title III, Part A Supplement Not Supplant, Professional Development

ESEA section 2301 requires that Title II, Part A funds are not used for professional development activities (i.e., the State's teacher preparation and retention programs) required by state law.

Title II, Part A SNS Professional Development Validation: Compare data on PS3104, applicable budget schedules, Title II, Part A Professional Development/Educator Growth worksheet (or equivalent), and supporting documentation from LEAs official accounting systems to demonstrate that professional development paid for with Title II, Part A funds is supplemental. 

ESEA section 3115 (g) requires that Title III, Part A funds be used to SNS federal, state, and local funds.

Title III, Part A SNS Professional Development Validation:  Compare data on PS3106, applicable budget schedules, Title III, Part A Professional Development Activities worksheet (or equivalent), and supporting documentation from LEAs official accounting systems to demonstrate that professional development paid for with Title III, Part A funds is supplemental.
