PROPOSED RULES CURRENTLY IN THE PUBLIC COMMENT PERIOD

Proposed Amendments to 19 TAC Chapter 74, Curriculum Requirements, Subchapter B, Graduation Requirements, §74.12, Foundation High School Program, and §74.13, Endorsements

Summary: The proposed amendments would align with recent changes to the Texas Essential Knowledge and Skills for fine arts and establish courses to be included in a cybersecurity pathway for the science, technology, engineering, and mathematics endorsement.

Procedural Action Related to New 19 TAC Chapter 113, Texas Essential Knowledge and Skills for Social Studies, Subchapter C, High School, §113.50, Ethnic Studies: Mexican American Studies (One Credit)

Summary: The proposed new section would add Texas Essential Knowledge and Skills for a new high school social studies course on Mexican American studies for implementation in the 2019-2020 school year. This rule action reflects the re-filing of the proposal adopted by the SBOE in September 2018, which expired due to a procedural error by the Texas Education Agency.

Proposed Repeal of 19 TAC Chapter 89, Adaptations for Special Populations, Subchapter D, Special Education Services and Settings, §89.62, Support of Students Enrolled in the Texas School for the Blind and Visually Impaired and Texas School for the Deaf
Summary: The proposed repeal would remove §89.62 as the SBOE's statutory authority for the rule was removed by House Bill 2 and Senate Bill 568, 89th Texas Legislature, Regular Session, 2025.

Summary: The proposed new section would update the Texas Essential Knowledge and Skills for the high school personal financial literacy course to ensure alignment with requirements in House Bill 27, 89th Texas Legislature, Regular Session, 2025, and ensure the standards remain current.

All new rules or amendments to existing rules with effective dates in the future are available on this site after the agency has filed the rules with the Texas Register. Rule actions will remain on this page until their effective dates.

Under state law, the State Board of Education (SBOE) must adopt a rule at least 90 days before the beginning of the school year for it to be effective for that school year. The exception to this process is if state or federal law requires an earlier effective date or the SBOE approves the rule by a two-thirds majority.

State Board of Education (SBOE) rules are part of a larger body of state agency rules known as the Texas Administrative Code (TAC). The Office of the Secretary of State collects and publishes these rules. SBOE rules are codified under Title 19, Part II, of the TAC. Title 19 is Education, and Part II is the Texas Education Agency. The SBOE may adopt new rules or amendments to or repeals of existing rules.

SBOE Rule Review Plan

Texas Government Code, §2001.039, establishes a four-year rule review cycle for all state agency rules, including SBOE rules. The rule review is designed to ensure that "the reason for adopting or readopting the rule continues to exist."

You may petition a state agency for the adoption of a rule or rule change according to the Administrative Procedure Act (Texas Government Code, §2001.021). The State Board of Education (SBOE) has adopted a rule that prescribes the form for a petition and the procedure for its submission, consideration, and disposition.

The procedure to petition for adoption of changes to SBOE rules is codified as 19 TAC §30.1.

Withdrawal of Proposed New 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, Subchapter H, Health Science, §130.210, Human Body Systems (One Credit)  

Proposed new 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, Subchapter H, Health Science, §130.210, Human Body Systems (One Credit), was published in the May 24, 2013, issue of the Texas Register (38 TexReg 3257). The proposal would have added new §130.210 as an additional option to satisfy the fourth science graduation requirement. Notice of the withdrawal will be published in the December 13, 2013, issue of the Texas Register.

Public Comment Period: May 15, 2026-5:00 p.m. on June 15, 2026. TEA will take registered oral and written comments on the proposed review at the appropriate committee meeting in June 2026 in accordance with the SBOE board operating policies and procedures.
