SUBJECT:    Required survey now available for all local educational agencies

On December 26, 2014, new federal regulations governing grant administration went into effect. Refer to The New EDGAR page of the TEA website for details on Title 2 of the Code of Federal Regulations (2 CFR), Part 200.

Real Property Purchased with Federal Grant Funds
Under 2 CFR §200.329, TEA must collect information from local educational agencies (LEAs) about any real property they purchased with federal grant funds. “Real property” is defined in 2 CFR §200.85 as land, land improvements, structures, and other accessories. Moveable machinery and equipment are not considered real property.
Note that any such purchases were likely made several years ago. Except in unusual circumstances, purchases of real property have not been allowed with federal education grant funds in recent years.

Required Data Collection
TEA has developed a survey to collect this information. Your LEA is required to respond, regardless of whether you ever used federal grant funds to purchase real property.

To complete the survey, you will need the following information for each real property purchase you made with federal grant funds before the 2015–2016 grant year:

•    Your LEA’s name, county-district number, and region number
•    Type of property purchased with federal grant funds prior to the 2015–2016 grant year, if any, such as land, buildings, or outdoor structures such as athletic fields, sidewalks, or parking
•    Purchase date, or approximate date if not known
•    Name of grant program whose funds were used for purchase
•    Ownership status
•    Description of how you disposed of the property, if applicable

Survey Access and Deadline
You may access the survey from the link in this letter or from the Compliance and Reporting page of the TEA website.

The deadline for completing and submitting the survey is October 31, 2015. After that date, TEA will contact LEAs that reported property purchases for additional information, as needed.
