Update to Plan for IDEA-B Maintenance of Effort Determinations

SUBJECT:      Update: Individuals with Disabilities Education Act, Part B (IDEA-B) Local Educational Agency (LEA) Maintenance of Effort (MOE) Requirement

The purpose of this letter is to provide LEAs with an important update to the Texas Education Agency's (TEA’s) plan regarding IDEA-B LEA MOE compliance determinations. TEA has decided to issue compliance determinations beginning with fiscal year 2015.

TEA will use FY 2014 data from the Public Education Information Management System to establish a baseline for each LEA. This baseline will be used to calculate preliminary determinations for FY 2015, which will be issued to LEAs in the spring of 2016. No determinations will be issued for fiscal years prior to 2015 at this time.

This plan supersedes, and is substantially different from, the previous plan announced in the To The Administrator Addressed letter dated September 30, 2013.

Training

So that LEAs can fully understand MOE compliance requirements and the calculation methodology, TEA has scheduled training sessions at education service centers (ESCs) around the state. The training schedule is as follows:
