Nonpublic Day and Residential Guidance

A school district may contract for residential placement when a student’s admission, review, and dismissal (ARD) committee determines that a residential placement is necessary in order for the student to receive a free appropriate public education (FAPE) (19 §TAC 89.61(a)).  A school district which intends to contract for residential placement through the residential application process (19 TAC §89.61(a)(3)).  Requests for approval of state and federal funding for residentially-placed students shall be negotiated (19 TAC §89.61(b)).

  The agency also provides funds to districts for the educational costs for students with disabilities who are referred to nonpublic day schools by the district (19 TAC §89.63(e)).
