2. Approval of Consent Agenda


Any agenda item may be placed on the Consent Agenda by any State Board of Education committee.

3. Approval of Proclamation 2019 Questions and Answers

Proclamation 2019, issued by the State Board of Education (SBOE) in April 2017, calls for instructional materials in English language arts and reading, grades K-8; Spanish language arts and reading, grades K-6; English Learners Language Arts, grades 7 and 8; handwriting (English and Spanish), grades K-5; spelling (English and Spanish), grades 1-6; and Personal Financial Literacy. Publishers and other stakeholders were given an opportunity to ask questions at an orientation meeting held in March 2017 and encouraged to submit additional questions through email. The resulting question and answer document for Proclamation 2019 will be presented for board approval. Statutory authority for this action is the Texas Education Code (TEC), §31.022.

4. Proposed New 19 TAC Chapter 110, Texas Essential Knowledge and Skills for English Language Arts and Reading, Subchapter C, High School, and 19 TAC Chapter 128, Texas Essential Knowledge and Skills for Spanish Language Arts and Reading and English as a Second Language, Subchapter C, High School

This item presents for second reading and final adoption proposed new 19 TAC Chapter 110, Texas Essential Knowledge and Skills for English Language Arts and Reading, Subchapter C, High School, and 19 TAC Chapter 128, Texas Essential Knowledge and Skills for Spanish Language Arts and Reading and English as a Second Language, Subchapter C, High School. The proposed rules recommend an implementation date of the 2020-2021 school year. Statutory authority for this action is the Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.025.

5. Update on Texas Essential Knowledge and Skills (TEKS) Review

This item provides the opportunity for staff to present an update on the review of the Texas Essential Knowledge and Skills (TEKS). The item also provides the opportunity for the board to take action regarding the processes for revision and streamlining of the TEKS. Statutory authority for this action is the Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.025.

6. Proposed Repeal of 19 TAC Chapter 114, Texas Essential Knowledge and Skills for Languages Other Than English, Subchapter A, Elementary, §114.1 and §114.2, Subchapter B, Middle School, §114.11 and §114.12, and Subchapter C, High School, §§114.21-114.29
(Second Reading and Final Adoption)


This item presents for second reading and final adoption proposed repeal of 19 TAC Chapter 114, Texas Essential Knowledge and Skills for Languages Other than English, Subchapter A, Elementary, §114.1 and §114.2, Subchapter B, Middle School, §114.11 and §114.12, and Subchapter C, High School, §§114.21-114.29. The proposed repeal would remove the Texas Essential Knowledge and Skills (TEKS) adopted to be effective in 1998 for elementary, middle, and high school languages other than English (LOTE), and related implementation language, that will be superseded by new 19 TAC §§114.3, 114.4, 114.13, 114.14, and 114.31-114.52 beginning with the 2017-2018 school year. Statutory authority for this action is the Texas Education Code (TEC), §§7.102(c)(4), 28.002, and 28.025.

7. Proposed Approval of Innovative Courses

This item recommends approval of innovative courses that do not fall within any of the subject areas of the foundation or enrichment curriculum. Statutory authority for this action is the Texas Education Code (TEC), §28.002(f).

8. Consideration of Removal of Certain Products from the List of Adopted Instructional Materials

This item provides an opportunity for the State Board of Education (SBOE) to consider removing specific products from the list of adopted instructional materials because the accessibility requirements for those products have not been met. Statutory authority for this action is the Texas Education Code (TEC), §31.022 and §31.028.

9. Review of the Commissioner of Education’s Generation 22 Charter Proposals

This item provides the committee and board an opportunity to review the commissioner’s list of proposed Subchapter D Open-Enrollment Charter Schools scheduled to open in school year 2018-2019. If awarded, the charters will have an initial five-year term with a July 31, 2023 contract end date. Statutory authority for this action is the Texas Education Code (TEC), §12.101.

This item outlines the rule review plan for State Board of Education (SBOE) rules during the period of September 2017 through August 2021. Texas Government Code, §2001.039, requires an ongoing four-year rule review of existing state agency rules, including SBOE rules. The rule review requirement is designed to ensure that the reason for initially adopting or readopting a rule continues to exist.

5. State Board of Education Meeting Schedule for 2018

According to the Texas Education Code, §7.106, the State Board of Education (SBOE) is to hold four meetings a year in Austin, Texas on dates determined by the chair. The SBOE may also hold other meetings as may be called by the chair. The purpose of this item is to announce SBOE meeting dates in 2018.

6. Review of Annual Audit Plan of the Division of Financial Compliance for 2017-2018 School Year

This item covers the annual audit plan of the Division of Financial Compliance for the 2017-2018 school year for field and independent financial reviews as specifically described in 19 TAC Chapter 109, Texas Education Agency Audit Functions, §109.21, Annual Audit Plan.
