SUBJECT:    Upcoming School Health and Related Services (SHARS) Reporting Requirement

All Texas local educational agencies (LEAs) and fiscal agents that received or administered Individuals with Disabilities Education Act, Part B (IDEA-B) grant funds in the 2013–2014 or 2014–2015 school year are subject to the reporting requirement related to the School Health and Related Services (SHARS) program.

You are required to submit the SHARS Reimbursement Report Form, regardless of whether you participated in the SHARS program. TEA will announce the availability of the form in a To the Administrator Addressed letter, to be published in mid-September 2015. The form will be available through the secure GFFC Reports and Data Collections application, which you will also use to submit the form. The form requires LEAs to enter SHARS data for the 2013–2014 and 2014–2015 school years and is due in October 2015.

TEA will use the information you report in its calculations to determine IDEA-B, LEA Maintenance of Effort (MOE) compliance for school year 2014-2015.

SHARS and IDEA-B LEA MOE
The SHARS program allows Texas LEAs to request Medicaid reimbursement for certain health-related services provided to students with disabilities.

In February 2014, TEA posted the SHARS and IDEA-B LEA MOE Guidance document on the IDEA-B LEA Maintenance of Effort page of the agency website. This document explains to LEAs how to account for any special education expenditures made with SHARS reimbursements, for the purpose of accurately calculating IDEA-B LEA MOE compliance.

In accordance with Title 34 of the Code of Federal Regulations (34 CFR) §300.154(g)(2), when SHARS reimbursements are expended again in state and local expenditures for special education services, that subsequent expenditure must be excluded for IDEA-B LEA MOE purposes from the final calculation of state and local expenditures.

SHARS Reimbursement Report Form
You will use the SHARS Reimbursement Report Form to report the one of three possible options that applies to you for both the 2013–2014 and 2014–2015 school years:
•    Option 1: The LEA did not participate in the SHARS Medicaid program and thus did not receive any SHARS Medicaid reimbursements to expend again in the special education program.
•    Option 2: The LEA did receive SHARS Medicaid reimbursements but did not expend any of the reimbursements in the special education program.
•    Option 3: The LEA did receive SHARS Medicaid reimbursements and made subsequent expenditures with the reimbursements in the special education program.
 
If option 3 applies to you, you will report the total amount of your subsequent expenditures. The total must include the amount, if any, the fiscal agent expended on behalf of your LEA.
