SUMMARY:
This item presents for first reading and filing authorization proposed revisions to 19 TAC Chapter 74, Curriculum Requirements, Subchapter A, Required Curriculum, to align rules for the required secondary curriculum, including courses school districts must offer, with requirements of House Bill (HB) 5, 83rd Texas Legislature, Regular Session, 2013.

STATUTORY AUTHORITY: Texas Education Code (TEC), §§7.102(c)(4), 28.002 as amended by HB 5 and HB 2662, 83rd Texas Legislature, Regular Session, 2013; and 28.025, as amended by HB 5.

EFFECTIVE DATE: The proposed effective date of the proposed revisions to 19 TAC Chapter 74, Subchapter A, is 20 days after filing as adopted with the Texas Register. Under TEC, §7.102(f), the State Board of Education (SBOE) must approve the rule actions at second reading and final adoption by a vote of two-thirds of its members to specify an effective date earlier than the beginning of the 2014-2015 school year. The earlier effective date will enable districts to plan for future course offerings and schedule students in courses appropriately.

PREVIOUS BOARD ACTION: The SBOE adopted 19 TAC Chapter 74, Subchapter A, effective September 1, 1996. Sections 74.1 and 74.3 were last amended effective May 30, 2012. At the November 2013 meeting, the SBOE postponed a discussion item regarding proposed revisions to 19 TAC Chapter 74, Subchapter A, until the January 2014 meeting when the SBOE could consider the item for first reading and filing authorization.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES: The 83rd Texas Legislature, Regular Session, 2013, passed HB 5, amending the TEC, §28.025, to change the high school graduation programs from the current minimum, recommended, and advanced high school programs to one foundation high school program with endorsements to increase flexibility in graduation requirements for students.

The proposed revisions to 19 TAC Chapter 74, Curriculum Requirements, Subchapter A, Required Curriculum, shown as Attachment II, would align rules for the required secondary curriculum, including courses school districts must offer, with the requirements of HB 5. The proposed revisions would also move the requirements related to the academic achievement record from 19 TAC Chapter 74, Subchapter B, to 19 TAC Chapter 74, Subchapter A.

FISCAL IMPACT: Fiscal implications of the proposed revisions will be assessed after the SBOE approves proposed revisions for first reading and filing authorization.

PUBLIC AND STUDENT BENEFIT: Benefits include added flexibility in course options for students to meet high school graduation requirements.

PROCEDURAL AND REPORTING IMPLICATIONS: Procedural and reporting implications will be assessed after the SBOE approves proposed revisions for first reading and filing authorization.

LOCALLY MAINTAINED PAPERWORK REQUIREMENTS: The proposed rule actions would have no new locally maintained paperwork requirements.

PUBLIC COMMENTS: The official public comment period will begin when the proposal is published in the Texas Register.

ALTERNATIVES: None.

OTHER COMMENTS AND RELATED ISSUES: A request for a public hearing on the proposal submitted under the Administrative Procedure Act must be received by the commissioner of education not more than 14 calendar days after notice of the proposal has been published in the Texas Register.

A public hearing on proposed revisions to 19 TAC Chapter 74, Curriculum Requirements, Subchapter B, Graduation Requirements, is presented for discussion as a separate item in this agenda. Additionally, proposed revisions to 19 TAC Chapter 74, Subchapter B, are presented for second reading and final adoption as a separate item in this agenda.

MOTION TO BE CONSIDERED: The State Board of Education:

Approve for first reading and filing authorization proposed revisions to 19 TAC Chapter 74, Curriculum Requirements, Subchapter A, Required Curriculum.
