SUMMARY:
This item presents for second reading and final adoption proposed revisions to 19 TAC Chapter 74, Curriculum Requirements, Subchapter A, Required Curriculum, to align rules for the required secondary curriculum, including courses school districts must offer, with requirements of House Bill (HB) 5, 83rd Texas Legislature, Regular Session, 2013. No changes are recommended since approved for first reading.

STATUTORY AUTHORITY: Texas Education Code (TEC), §§7.102(c)(4); 28.002, as amended by HB 5 and HB 2662, 83rd Texas Legislature, Regular Session, 2013; and 28.025, as amended by HB 5.

EFFECTIVE DATE: The proposed effective date of the proposed revisions to 19 TAC Chapter 74, Subchapter A, is 20 days after filing as adopted with the Texas Register. Under TEC, §7.102(f), the State Board of Education (SBOE) must approve the rule actions at second reading and final adoption by a vote of two-thirds of its members to specify an effective date earlier than the beginning of the 2014-2015 school year. The earlier effective date will enable districts to plan for future course offerings and schedule students in courses appropriately.

PREVIOUS BOARD ACTION: The SBOE adopted 19 TAC Chapter 74, Subchapter A, effective September 1, 1996. Sections 74.1 and 74.3 were last amended effective May 30, 2012. At the November 2013 meeting, the SBOE postponed a discussion item regarding proposed revisions to 19 TAC Chapter 74, Subchapter A, until the January 2014 meeting when the SBOE could consider the item for first reading and filing authorization. The SBOE approved proposed revisions to 19 TAC Chapter 74, Subchapter A, as amended, for first reading and filing authorization at the January 2014 meeting.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES:  The 83rd Texas Legislature, Regular Session, 2013, passed HB 5, amending the TEC, §28.025, to change the high school graduation programs from the current minimum, recommended, and advanced high school programs to one foundation high school program with endorsements to increase flexibility in graduation requirements for students.

The proposed revisions to 19 TAC Chapter 74, Curriculum Requirements, Subchapter A, Required Curriculum, shown as Attachment II, would align rules for the required secondary curriculum, including courses school districts must offer, with the requirements of HB 5. The proposed revisions would also move the requirements related to the academic achievement record from 19 TAC Chapter 74, Subchapter B, to 19 TAC Chapter 74, Subchapter A.

No changes are recommended since approved for first reading.


FISCAL IMPACT:  The Texas Education Agency has determined that there are no additional costs to persons or entities required to comply with the proposed rule actions. In addition, there is no direct adverse economic impact for small businesses and microbusinesses; therefore, no regulatory flexibility analysis, specified in Texas Government Code, §2006.002, is required.

PUBLIC AND STUDENT BENEFIT: Benefits include added flexibility in course options for students to meet high school graduation requirements.

PROCEDURAL AND REPORTING IMPLICATIONS: The proposed revisions would have no new procedural and reporting requirements.

LOCALLY MAINTAINED PAPERWORK REQUIREMENTS: The proposed revisions would have no new locally maintained paperwork requirements.

PUBLIC COMMENTS: Following the January 2014 SBOE meeting, notice of the proposed revisions to 19 TAC Chapter 74, Curriculum Requirements, Subchapter A, Required Curriculum, was filed with the Texas Register, initiating the official public comment period. No comments had been received at the time this item was prepared. A summary of any public comments received regarding the proposal will be provided to the SBOE prior to and during the April 2014 meeting.

OTHER COMMENTS AND RELATED ISSUES:  None.

MOTION TO BE CONSIDERED:  The State Board of Education:

By an affirmative vote of two-thirds of the members of the board, approve for second reading and final adoption proposed revisions to 19 TAC Chapter 74, Curriculum Requirements, Subchapter A, Required Curriculum, with an effective date of 20 days after filing as adopted with the Texas Register.
