December 2013 Summary of State Board for Educator Certification Rule Actions

1. Adopted New 19 TAC Chapter 230, Professional Educator Preparation and Certification, Subchapter B, General Certification Requirements, §230.15, Certification of Military Service Members, Military Spouses, and Military Veterans

Effective Date: December 23, 2013.

New 19 TAC Chapter 230, Professional Educator Preparation and Certification, Subchapter B, General Certification Requirements, §230.15, Certification of Military Service Members, Military Spouses, and Military Veterans, was filed as adopted with the Texas Register on December 3, 2013.

Adopted new 19 TAC §230.15 is necessary as a result of Senate Bill (SB) 162, 83rd Texas Legislature, Regular Session, 2013, which requires all state licensing agencies to adopt rules that implement the requirements of the Texas Occupations Code, Chapter 55, regarding the licensing of military service members, military spouses, and military veterans by January 1, 2014. New 19 TAC §230.15, Certification of Military Service Members, Military Spouses, and Military Veterans, was adopted with no changes from what was published as proposed.

Effective Date: December 23, 2013.

New 19 TAC Chapter 232, General Certification Provisions, Subchapter A, Certificate Renewal and Continuing Professional Education Requirements, §232.27, Renewal and Continuing Education Requirements for Military Service Members, was filed as adopted with the Texas Register on December 3, 2013.

3. Adopted Amendment to 19 TAC Chapter 233, Categories of Classroom Teaching Certificates, §233.14, Career and Technical Education (Certificates requiring experience and preparation in a skill area)

Effective Date: December 26, 2013.

Amended 19 TAC Chapter 233, Categories of Classroom Teaching Certificates, §233.14, Career and Technical Education (Certificates requiring experience and preparation in a skill area), was filed as adopted with the Texas Register on December 6, 2013.

The adopted amendment to 19 TAC §233.14 is necessary as a result of House Bill (HB) 3573, 83rd Texas Legislature, Regular Session, 2013, which amended Texas Education Code, §21.044(e), to limit the requirements that can be imposed by the SBEC for obtaining a certificate to teach a health science technology education course. The amendment to 19 TAC §233.14, Career and Technical Education (Certificates requiring experience and preparation in a skill area), was adopted with no changes from what was published as proposed.

Effective Date: December 23, 2013.

Amended 19 TAC Chapter 249, Disciplinary Proceedings, Sanctions, and Contested Cases, Subchapter A, General Provisions, §249.5, Purpose, and Subchapter B, Enforcement Actions and Guidelines, §249.17, Decision-Making Guidelines, was filed as adopted with the Texas Register on December 3, 2013.

The amendments to 19 TAC §249.5 and §249.17 adopt parts of the SBEC disciplinary policy guidelines in rule. The amendments to 19 TAC §249.5, Purpose, and §249.17, Decision-Making Guidelines, were adopted with no changes from what was published as proposed.
